Terms and Conditions

Welcome to EdNectar Technologies Pvt. Ltd. (hereinafter called “EdNectar,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the EdNectar platform, including our website, mobile applications, and all associated services (collectively, the “Platform”), which provides educational simulations of real-world criminal proceedings based on Indian criminal laws. By accessing or using the Platform, you (hereinafter called “User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

1. Definitions

For the purposes of these Terms, the following terms have the meanings set forth below:

  • Platform: Refers to EdNectar’s website, mobile applications, including all associated services, tools, and content provided for educational purposes etc.
  • User: Any individual or entity accessing or using the Platform, including but not limited to registered users, guests, and subscribers.
  • Content: All materials available on the Platform, including but not limited to case studies, worksheets, legal simulations, videos, AI-evaluated assessments, text, graphics, software, and other educational resources.
  • User-Generated Content: Any content, including responses, comments, feedback, or other inputs, created or submitted by Users on the Platform.
  • Subscription: Any paid plan or service offered by EdNectar that provides access to premium features or content.

  • Account: A User’s registered profi le on the Platform, created through the registration process.

2. Eligibility

The Platform is designed for individuals and entities with an interest in learning about Indian criminal laws and its actual proceedings in administration of criminal justice. Eligible Users include:

  • Law Students & Aspirants: Individuals enrolled in or preparing for law-related academic programs.
  • Legal Professionals: Practicing lawyers, advocates, or legal consultants seeking to enhance their knowledge.
  • Academicians & Researchers: Faculty members, scholars, or researchers in the fi eld of law or criminology.
  • Law Enforcement Personnel: Police offi cers, investigators, or other personnel involved in law enforcement.
  • Journalists & Legal Writers: Media professionals or writers covering legal topics or criminal justice.
  • Interested Learners: Individuals with a foundational understanding of legal concepts who are passionate about exploring criminal law for personal knowledge, professional development, or career prospects.

Minimum Age: Users must be at least 18 years old or have the consent of a parent or legal guardian to use the Platform. By accessing the Platform, you represent and warrant that you meet these eligibility requirements.

3. Registration and Account Security

3.1. Registration:

To access certain features of the Platform, you must create an Account by providing accurate, complete, and up-to-date information during the registration process. You agree to update your Account information promptly if there is any change after registration also.

3.2. Account Security:

  • You are responsible for maintaining the confi dentiality of your Account credentials, including your username and password.
  • You agree to notify EdNectar immediately at contact@ednectar.com if you suspect any unauthorized access to or use of your Account.
  • You are solely responsible for all activities conducted through your Account, whether authorized or unauthorized, unless you have reported unauthorized access to EdNectar.

3.3. Account Suspension/Termination:

EdNectar reserves the right to suspend or terminate your Account, with or without notice, if we suspect unauthorized activity, fraudulent behavior, or violation of these Terms.

3.4. Single Account:

Each User is permitted to maintain only one Account. Creating multiple Accounts with the existing credentials for the same User is strictly prohibited and may result in suspension or termination of the account without any prior notice.

4. Use of the Platform

4.1. Purpose:

The Platform provides educational content and simulations of criminal proceedings under Indian laws for learning purposes. It is intended to enhance Users’ understanding of legal concepts and is not a substitute for professional legal advice or real-world legal proceedings.

4.2. Permitted Use:

  • Users may access and use the Platform solely for personal, non-commercial, educational purposes unless otherwise specifi ed in a separate agreement with EdNectar.
  • Users may participate in simulations, complete assessments, and engage with Content as permitted by their Subscription or access level.

4.3. Prohibited Conduct: You agree not to:

  • Use the Platform for any illegal, unethical, or unauthorized purposes.
  • Attempt to manipulate, hack, reverse-engineer, or otherwise interfere with the Platform’s functionality or security.
  • Use automated tools, bots, or scripts to access or scrape the Platform.
  • Engage in conduct that is harassing, abusive, defamatory, or otherwise harmful to other Users or EdNectar.
  • Share your Account credentials with others or allow unauthorized access to your Account.
  • Use the Platform to distribute spam, malware, or other harmful content.

4.4. Consequences of Misuse:

Any violation of these Terms may result in immediate suspension or termination of your access to the Platform, without refund, and may lead to legal action if applicable.

5. Intellectual Property Rights

5.1. Ownership:

All Content on the Platform, including but not limited to text, graphics, logos, software, simulations, assessments, and other materials, is owned by or licensed to EdNectar and is protected by Indian and international copyright, trademark, and other intellectual property laws.

5.2. License to Users:

EdNectar grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for personal, non-commercial educational purposes, subject to these Terms.

5.3. Restrictions:

  • You may not copy, reproduce, distribute, modify, create derivative works, or publicly display any Content without prior written consent from EdNectar.
  • You may not use EdNectar’s trademarks, logos, or branding without express permission.
  • Any unauthorized use of Content may result in termination of your access and legal action.

5.4. Feedback:

If you provide feedback, suggestions, or ideas about the Platform (“Feedback”), you grant EdNectar a perpetual, worldwide, royalty-free, irrevocable license to use, incorporate, and distribute such Feedback without any obligation to you.

6. User-Generated Content

6.1. Submission:

Users may submit responses, comments, answers to assessments, or other inputs as part of their engagement with the Platform (“User-Generated Content”).

6.2. License to EdNectar:

By submitting User-Generated Content, you grant EdNectar a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and display such content for purposes related to the Platform, including marketing, improving services, and creating derivative works.

6.3. Content Standards: User-Generated Content must not:

  • Violate any applicable laws, including copyright, trademark, or privacy laws.
  • Contain obscene, defamatory, offensive, or discriminatory material.
  • Infringe on the rights of any third party.
  • Contain viruses, malware, or other harmful components.

6.4. Moderation:

EdNectar reserves the right to review, monitor, edit, or remove any User-Generated Content that violates these Terms or is otherwise objectionable, at our sole discretion, without prior notice.

6.5. Responsibility:

You are solely responsible for the User-Generated Content you submit and any consequences arising from it.

7. Payment and Subscription

7.1. Fees:

Access to certain features, Content, or services on the Platform may require payment or a Subscription. All fees are quoted in Indian Rupees (INR) unless otherwise specifi ed.

7.2. Payment Terms:

  • Payments must be made through the designated payment methods provided on the Platform.
  • You agree to provide accurate payment information and authorize EdNectar to charge the applicable fees to your chosen payment method.

7.3. Non-Refundable:

All payments, including Subscription fees, are non-refundable unless otherwise stated in writing by EdNectar or required by applicable law.

7.4. Subscription Plans:

  • Subscriptions may be offered on a monthly, quarterly, or annual basis, as specifi ed on the Platform.
  • Subscriptions may auto-renew unless you cancel before the renewal date. You will be notifi ed of the renewal process and any changes to Subscription fees.

7.5. Price Changes:

EdNectar reserves the right to modify pricing and Subscription plans at any time. Any changes will be communicated to you in advance, and continued use of the Platform after such changes constitutes acceptance of the new pricing.

7.6. Free Trials:

If EdNectar offers a free trial, the terms of the trial will be specifi ed at the time of registration. EdNectar reserves the right to limit or terminate free trials at its discretion.

8. Data Protection and Privacy

8.1. Collection and Use:

EdNectar collects and processes personal data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your data as described in the Privacy Policy.

8.2. Data Security:

EdNectar implements reasonable technical and organizational measures to protect your personal data. However, no system is completely secure, and you acknowledge that data transmission over the internet involves inherent risks.

8.3. User Responsibility:

You are responsible for ensuring that any personal data you provide is accurate and complies with applicable laws.

8.4. Compliance:

EdNectar complies with the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable data protection laws in India.

9. Third-Party Services and Links

9.1. Third-Party Integrations:

The Platform may integrate with third-party services, such as payment processors or analytics tools. EdNectar is not responsible for the performance, security, or terms of such third-party services.

9.2. External Links:

The Platform may contain links to external websites or resources. EdNectar does not endorse or control such external sites and is not liable for any content, services, or damages arising from your use of them.

10. Disclaimer of Warranties

10.1. Educational Purpose:

The Platform is primarily an educational tool and does not provide legal advice, representation, or real-world legal proceedings. Content and simulations are for learning purposes only.

10.2. As-Is Basis:

The Platform and Content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, availability, or fi tness for a particular purpose.

10.3. No Guarantee:

EdNectar does not guarantee that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

10.4. User Risk:

Your use of the Platform and reliance on any Content or simulations is at your own risk.

11. Limitation of Liability

11.1. No Liability:

To the fullest extent permitted by law, EdNectar, its affi liates, offi cers, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of data, profi ts, or opportunities.

11.2. Cap on Liability:

If EdNectar is found liable for any damages, our total liability shall not exceed the amount paid by you for your Subscription in the preceding 12 months.

11.3. Acknowledgment:

You acknowledge that the educational nature of the Platform involves inherent limitations, and you assume all risks associated with your use of the Content.

12. Termination and Suspension

12.1. By EdNectar:

EdNectar may suspend or terminate your access to the Platform, with or without notice, for:

  • Violation of these Terms.
  • Unauthorized or fraudulent activity.
  • Non-payment of fees.
  • Any other reason deemed necessary to protect the Platform or other Users.

12.2. By User:

You may terminate your Account at any time by following the instructions provided on the Platform. Upon termination, you will lose access to all Content and features associated with your Account.

12.3. Effect of Termination:

Upon termination, all licenses granted to you under these Terms will cease, and you must stop using the Platform. Any outstanding fees remain payable, and no refunds will be provided unless required by law.

13. Governing Law and Dispute Resolution

13.1. Governing Law:

These Terms shall be governed by and construed in accordance with the applicable laws in India.

13.2. Dispute Resolution:

  • Any disputes arising from or related to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Delhi, India and information/notice in that regard shall be communicated at contact@ednectar.com mandatorily and both parties shall undergo pre-institutional mediation at *LlMA (Lloyd Institute of Mediation and Arbitration Plot 3 Knowledge Park – II, Greater Noida, Uttar Pradesh, 201310) before commencing any legal proceedings.

14. Changes to Terms and Conditions

14.1. Right to Modify:

EdNectar reserves the right to modify these Terms at any time. Changes will be effective upon posting the same on the Platform or any other means.

14.2. Acceptance of Changes:

Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and inform at contact@ednectar.com.

15. Force Majeure

EdNectar shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, war, terrorism, or technical failures.

16. Miscellaneous

16.1. Entire Agreement:

These Terms, together with the Privacy Policy, constitute the entire agreement between you and EdNectar regarding your use of the Platform.

16.2. Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3. No Waiver:

EdNectar’s failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

16.4. Assignment:

EdNectar alone may assign its rights and obligations under these Terms to any third party without your consent or prior notice. It is reiterated that you cannot assign, or transfer your rights or obligations qua the Platform under any circumstances.

16.5. Headings:

Headings in these Terms are for convenience only and do not affect the interpretation of the provisions.
